New Machine Regulation

It was published in the Official Journal of the European Union, and the regulation will take effect from January 14, 2027. Until January 13, 2027, the Machinery Directive 2006/42/EC remains in effect. The new regulation aims to adapt EU law to emerging technologies in machinery products. Technological advancements in digitalization, machine learning, the Internet of Things (IoT), and software that updates automatically without human intervention, along with many other technological challenges, have compelled the adaptation of European Union law to new realities.

  • The new Machinery Regulation 2023/1230 (MR) was published on June 29 2023.
  • The Machinery Directive 2006/42/EC will be repealed, and MR will take effect from 14/01/2027.
  • Until January 20, 2027, there is no voluntary application of MR; however, the following articles will enter into force:
    • Articles 26 to 42 from January 14, 2024,
    • Article 50(1) from October 14, 2023,
    • Article 6(7) and Articles 48 and 52 from July 13, 2023,
    • Article 6(2) to (6), (8), and (11) and Articles 47 and 53(3) from July 14, 2024.
  • At present, there is no list of standards aligned with the new MR,
  • In adherence to current practice, Annexes Z will be prepared for the Machinery Directive 2006/42/EC and the new Machinery Regulation 2023/1230. They will include a list of harmonized standards to be utilized during the transitional period.
